This Privacy Policy explains how Archer Affiliates Corp and our affiliated entities ("we", "us", "our", or "Archer") collect, use, maintain, and disclose information about you when you use our platform at archeraffiliates.com and related services (the "Platform"). The Platform connects brands with publishers across Amazon's global marketplaces using Amazon Attribution as its core infrastructure.

We designed the Platform with privacy in mind. We strive to minimize the personal information we process and offer the transparency and controls described in this Policy. Please read it carefully before using the Platform. By accessing or using the Platform, you accept this Policy and our Terms of Service available at https://www.archeraffiliates.com/terms-of-service.

The Basics

Before getting into the details, here is what matters most:

  • We collect and process limited personal information, primarily what you provide when you register, use the Platform, or contact us for support.
  • We do not sell, share, trade, or rent your personal information to third parties. We never have.
  • We do not collect consumer data from your connected Amazon account unless you choose to authorize it.
  • Our core service relies on Amazon Attribution data. That data is aggregate in nature and does not identify the individual consumers who interact with publisher links or view brand listings.
  • We are committed to transparency about how we use your information and will notify you before making material changes to this Policy.

Updates to This Policy

As the Platform evolves, we will update this Policy. If we intend to materially change how we use your personal information, we will notify you before those changes take effect, typically at least two weeks in advance. Where we have your email address, we will use it to notify you. We may also post a notice on the Platform.

You acknowledge that it is your responsibility to review the Last Updated date periodically. Your continued use of the Platform after any update constitutes your acceptance of the revised Policy.

Amazon Attribution Information

To facilitate Amazon product synchronization and affiliate attribution across global marketplaces, we connect with the Amazon Attribution API via an Amazon Ads API connection. This connection and its associated attribution data is used solely to provide the Platform to you and the brands and publishers you work with. We may use aggregate and anonymized data to improve system performance or track usage of certain features.

Information We Collect and How We Use It

This section describes each category of information we collect, how we collect it, why we use it, the legal basis for that use, and how long we keep it. We may also deidentify and aggregate information for the purpose of improving the Platform or developing new services.

Attribution Information

We collect aggregate data from interactions with Platform-generated Attribution links on Amazon marketplaces. This includes total clicks and purchases on listings, typically aggregated over a daylong period, along with identifiers for the relevant brands and publishers.

How we collect it: Passively, once you authorize collection through your Amazon Ads API connection. Collection stops when you revoke authorization.

Why we use it: To provide the core features of the Platform, including data reporting, invoicing, analytics, and commission calculations.

Legal basis: Performance of our contracts with the applicable brand and publisher. Legitimate interest in improving the Platform.

How long we keep it: No less than 24 months, or longer where required by applicable law.

Amazon Ads API Data

We collect enhanced data made available by the Amazon Attribution API connected to the Platform, including campaign-level performance data and ASIN-level reporting where authorized.

How we collect it: Passively, once you directly authorize collection. Collection stops when you revoke authorization.

Why we use it: To provide additional platform features including ASIN-level attribution reporting, commission calculations, and campaign analytics.

Legal basis: Performance of our contracts with the applicable brand and publisher. Legitimate interest in improving the Platform.

How long we keep it: No less than 24 months, or longer where required by applicable law.

Account and Identity Information

We collect your name, address, email address, phone number, and login credentials when you register for the Platform or otherwise communicate with us.

How we collect it: Directly, as provided by you during registration, form submission, or communications with our support team.

Why we use it: To provide and improve customer service, send important account notices and updates, and for marketing and promotional purposes unless you opt out.

Legal basis: Performance of our contracts with you. Legitimate interest in improving the Platform and communicating with users.

How long we keep it: For the lifetime of your account, unless you request deletion or we are required to retain it for legal or compliance purposes.

Professional and Employment Information

We collect information you choose to include in your profile about your employer, business affiliations, or history of affiliate marketing activity.

How we collect it: Directly, as provided by you.

Why we use it: To provide and improve the Platform, and to display profile content to other users on the Platform as you intend.

Legal basis: Performance of a contract. Legitimate interest in improving the Platform.

How long we keep it: For the lifetime of your account, or until you request removal.

Commission and Payment Records

We collect information related to commission rates, commissionable amounts, transaction amounts, and the timing of transactions.

How we collect it: Directly, as set or determined by you, and passively from Amazon Attribution data and payment provider records.

Why we use it: To provide the Platform, ensure compliance, process payments, and improve customer service.

Legal basis: Performance of our contracts. Fraud prevention and legal compliance.

How long we keep it: No less than 24 months, or longer where required by applicable law.

Geolocation Data

We collect your general region or area based in part on your IP address when you access the Platform.

How we collect it: Passively, through automatic data collection tools including cookies and web beacons.

Why we use it: To detect unusual or potentially unauthorized logins, to set language preferences, and to tailor publisher and brand suggestions.

Legal basis: Performance of a contract. Fraud prevention and legal compliance.

How long we keep it: For the lifetime of your account, unless you request deletion or we are required to retain it.

Platform Activity

We collect referral channels that led you to the Platform, browsing and click history, device and browser information, IP address, page views, button clicks, navigation patterns, and the content of communications you send to our support team.

How we collect it: Passively, through first-party technology, Google Analytics, and other tracking tools. Directly, as provided by you when contacting support.

Why we use it: To provide and improve customer service, analyze usage trends, and send relevant updates, marketing, and promotional communications.

Legal basis: Legitimate interest in improving the Platform's usability and features. Performance of a contract.

How long we keep it: Periodically deleted in the ordinary course of business.

Inferences

We may derive inferences from any of the information described above, except consumer personal data and the content of Platform communications between users.

How we collect it: Derived from other collected data.

Why we use it: To enrich aggregate datasets, analyze predictions, and tailor publisher and brand suggestions.

Legal basis: Performance of a contract. Legitimate interest in improving the Platform.

How long we keep it: Only for the period applicable to the underlying data from which the inference was derived.

Platform Communications

We collect anything communicated to other users through the Platform, including content or data you upload.

How we collect it: Directly, as provided by you.

Why we use it: To deliver your message and any content you transmit to recipients. Where necessary, to comply with our legal obligations.

Legal basis: Performance of a contract.

How long we keep it: Periodically deleted in the ordinary course of business.

How We Share Your Information

We do not sell, share, trade, or rent your personal information. We have never provided or exchanged personal information with others to facilitate targeted advertising, and we have no intention of doing so.

We may disclose your information in the following limited circumstances:

  • With your consent or at your direct request.
  • With service providers who assist us in operating the Platform. These include payment processors (Stripe), analytics providers (Google Analytics), hosting services (Amazon Web Services), and customer support providers (HubSpot). Our service providers are contractually bound to process your information solely for the purpose of providing their services to us.
  • To comply with applicable law, including in response to lawful requests by public authorities, subpoenas, or regulatory requirements, and to deter and combat fraud, money laundering, and other illegal activity.
  • To protect the rights and property of Archer or a third party, or to protect the safety of the public or any person.
  • In connection with a reorganization, merger, or sale of Archer, in which case your personal information may be transferred to the relevant third party.

Information Security and Storage

We use commercially reasonable security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. That said, no system is perfectly secure and we cannot guarantee the complete safety of your information. You are responsible for keeping your account credentials confidential.

We store and process your information in the United States. We may transfer your information to service providers who process information in other countries. By using the Platform or otherwise providing information to us, you consent to having your personal information transferred to and processed in the United States.

Data Breach Notification

In the event of a data breach that is reasonably likely to result in a risk to your rights or interests, we will notify affected users and the relevant authorities as required by applicable law. We will provide notification without undue delay and within the timeframes required by the laws that apply to you.

How Long We Keep Your Information

We retain your information for the time necessary to fulfill the purpose for which it was collected, as described under each category above. Longer retention may be required by our compliance obligations under applicable legal, tax, accounting, and regulatory requirements.

In making retention decisions, we always consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, and whether we can achieve our purposes without continued retention.

No Children

The Platform is not directed to children under the age of 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a child, we will promptly delete it. How to Control Your Privacy

You have the following choices regarding your personal information:

  • Marketing communications: You can opt out of promotional communications by unsubscribing through the Platform or contacting us. If you opt out, we may still send non-promotional communications about your account or our ongoing business.
  • Cookies and tracking: Most browsers accept cookies by default. You can set your browser to remove or reject cookies, though doing so may affect the functionality of the Platform. On a mobile device, you may manage tracking through your device settings.

International Data Transfers

We receive and process your information in the United States. By using the Platform, you consent to the processing of your information in the United States. This transfer is necessary for the performance of our contract for use of the Platform.

U.S. law is not equivalent to laws in other countries, including the GDPR in Europe or PIPEDA in Canada. Where we transfer personal data subject to GDPR outside of Archer, we use Standard Contractual Clauses approved by the EU for that purpose, or another appropriate transfer mechanism recognized under applicable law. We may also choose to become party to the Data Privacy Framework between the U.S. and the EU, UK, or Switzerland.

Exercising Your Privacy Rights

Your request must provide sufficient information to identify you and indicate the law that applies to you, such as your name, email address, or mailing address. Please do not include sensitive identifiers such as social security numbers, driver's license numbers, credit card numbers, or health information.

We will verify requests by confirming the source and matching the submitted information to what we maintain on file. We will respond as quickly as practicable, in accordance with any deadlines required by the laws that apply to you.

Where the law that applies to you provides an appeal right, including laws in California, Colorado, Connecticut, and Virginia, you may appeal any decision we make regarding your request by contacting us through the same channel.

Local Privacy Laws

European Economic Area, United Kingdom, and Switzerland

If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation (GDPR) and applicable local law regarding the processing of your personal information. When we process your personal information, we do so on the basis of our legitimate interests, performance of a contract with you, compliance with a legal obligation, or your consent.

We do not sell or share your personal information as those terms are defined under applicable state law. Because we do not engage in those activities, we do not offer a separate opt-out mechanism for them.

We maintain safeguards designed to protect the security and confidentiality of personal information consistent with the requirements of the New York SHIELD Act. Our Platform does not respond to "Do Not Track" signals from web browsers. Some third-party websites may track your browsing activities. You can adjust your browser settings to indicate that you do not want to be tracked.
